Terms and Conditions of Business – Dk Express Ltd
These Terms and Conditions apply to all vehicle repair, maintenance, diagnostic services, and any parts supplied by Dk Express Ltd (“we”, “us”, “our”). By instructing us to carry out any work, you agree to be bound by these Terms.
1. Definitions
- “The Business”, “We”, “Us”, “Our” means Dk Express Ltd.
- “The Customer”, “You”, “Your” means the person, firm, or company with whom the contract for the supply of Services and/or Goods is made.
- “Services” means the vehicle repair, maintenance, and diagnostic work carried out by Us.
- “Goods” means any parts, materials, or products supplied by Us as part of the Services.
- “Invoice” means the document detailing the charges for Services and Goods provided.
2. Acceptance of Work
Any instruction, whether written or oral, to carry out repairs, supply Goods, or undertake any other Service constitutes acceptance of these Terms and Conditions.
Estimates are valid for 14 days and are subject to change if the work required differs from that initially quoted. You will be notified and must authorise any additional work before it proceeds.
3. Prices and Payment
3.1 Pricing
All prices are stated in Pounds Sterling (£) and are exclusive of VAT unless otherwise stated. VAT will be added at the prevailing rate.
3.2 Payment Terms
Payment for completed work and supplied Goods is due immediately upon completion of work and presentation of the Invoice. The vehicle will not be released until full payment is received, except by prior written agreement.
3.3 Late Payment
In the event that any Invoice remains due and unpaid beyond the completion of work, the following charges shall apply:
- A fixed administrative fee of £40 per Invoice.
- Interest on the outstanding amount shall accrue daily at a rate of 0.8% above the Bank of England’s prevailing Base Rate, plus an additional 0.4% per month of the total Invoice value.
- These combined interest charges shall continue to accrue until the debt has been settled in full, including through any court proceedings, up to the point where a final judgment or decision is rendered by the court.
3.4 Recovery Costs
The Customer shall be liable for all reasonable costs and expenses (including legal fees) incurred by Us in recovering overdue amounts.
4. Workmanship, Guarantees, and Liability
4.1 Guarantee
We guarantee our workmanship for a period of 12 months or the specific warranty period provided with any new parts, whichever is longer. This guarantee does not cover defects or failures caused by misuse, neglect, accidental damage, or failure to follow recommended maintenance schedules.
4.2 Limitation of Liability
Our liability for any loss or damage shall be limited to the value of the work carried out. We shall not be liable for any indirect, consequential, or incidental damages, including (but not limited to) loss of earnings, profit, or use of the vehicle.
4.3 Vehicle Safety & External Events
While we exercise all reasonable care, we cannot be held responsible for loss or damage to the vehicle or its contents from causes beyond our control (e.g., fire, theft, extreme weather), unless proven to be a direct result of our negligence.
5. Customer’s Vehicles and Property
5.1 Ownership & Authority
You warrant that you are the legal owner of the vehicle or have the authority of the legal owner to instruct Us to carry out the work.
5.2 Vehicle Photography
We may take and use photographs of your vehicle for work records, estimates, or promotional purposes.
5.3 Storage Charges
A daily storage of £15 + VAT/day will be applied to any vehicle left on our premises for more than 7 calendar days after you have been notified that work is complete.
6. Data Protection
We will process your personal data in accordance with our Privacy Policy, available upon request, and in compliance with applicable data protection laws (UK GDPR and Data Protection Act 2018).
7. General Provisions
7.1 Entire Agreement
These Terms and Conditions constitute the entire agreement between Dk Express Ltd and You.
7.2 Severability
If any part of these terms is found to be unenforceable, the remainder will continue in full force.
7.3 Governing Law
These terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts thereof.
7.4 Variations
No variation to these terms is valid unless agreed in writing by a director of Dk Express Ltd.
